New 10% Coming For Low-Value Goods
A significant shift is on the horizon as the government is set to implement a 10% sales tax on low-value goods (LVG), encompassing items priced below RM500, sold online and shipped to customers in Malaysia. This revolutionary tax system will be universally applicable, extending its reach across Malaysia, including customers in duty-free islands such as Labuan, Langkawi, Tioman, Pangkor, and specific tax-free zones or licensed warehouses.

The tax applies to all online sellers, regardless of their location, engaging in the sale of LVG on an online platform or operating within an online marketplace. Furthermore, it will be enforced on items valued at less than RM500 each, entering Malaysia via various means, including land, sea, or air. Notably, this 10% tax exemption does not extend to imported alcohol or smoking products. The list of exempted items from the LVG sales tax includes intoxicating liquors, cigarettes, tobacco products, smoking pipes (including pipe bowls), e-cigarettes or vaping devices, and e-cigarette or vaping liquid or gel (regardless of nicotine content).
When Will It Start &amp; How Much Do We Need To Pay For This New Tax?

The sales tax is scheduled to come into effect on January 1, 2024, after being initially slated for January 1, 2023, then deferred to April 1, 2023, and subsequently postponed indefinitely until the recent confirmation of its implementation date.
What does this signify for consumers? If you make LVG purchases before January 1, 2024, the newly imposed 10% sales tax will not be applicable, even if the items are delivered after this date. In simple terms, if the registered seller confirms the LVG order before January 1, the new sales tax won't be imposed, regardless of when the goods are shipped from overseas to the customer in Malaysia. However, the new sales tax will be applicable if the registered seller confirms the LVG order on or after January 1.
As for the amount of the tax, the 10% will be exclusive of additional charges such as transportation costs, delivery fees, or insurance costs associated with the products. Therefore, if you were to pay RM200 for an item, you would incur an additional RM20 on top of your regular delivery fees.

Trying to bypass the tax by consolidating LVG purchases to surpass RM500 will prove ineffective. The sales tax is applied individually to each LVG item priced below RM500. Even if the overall order amounts to RM600, the LVG sales tax will still be levied on each item priced at RM200.
Can We Still Get Discounts Or Apply For Vouchers?
In essence, the amount you pay for LVG sales tax hinges on whether the seller is offering a discount or if you're using a voucher. When it comes to a discount, the 10% sales tax isn't imposed on the original selling price; rather, it is calculated based on the discounted selling price.

When redeeming an RM50 voucher during checkout, it's important to note that the 10% sales tax will still be applied to the original selling price, which is determined before the voucher is applied. This is because the voucher is not considered a discount.

Additionally, it's crucial to be aware of the 'De Minimis' concept. When importing goods into Malaysia, three types of taxes may apply: Import Duty, Excise Duty, and Sales Tax on Imports. However, for goods with a total CIF (cost, insurance, and freight) value below RM500 per consignment imported via air courier services and postal services, the De Minimis facility comes into play. This means that Import Duty and Sales Tax on Imports will be exempted for such shipments.
